Supreme Court Upholds Decision On SALL

The Supreme Court has upheld its earlier decision validating the election of John Peter Amewu as the MP for Hohoe, in a judicial review.

The 7-member panel that reviewed the decision of the original 5-member panel held that the apex court had not erred in holding earlier that the Ho High Court erred when it granted an injunction against the gazetting of John Peter Amewu as Hohoe MP-elect.

And because no errors of law were committed by the judges to merit setting aside the decision, the appeal was dismissed.

Justices Yonny Kulendi and Prof Henrietta Mensa-Bonsu were the two added to constitute the 7-member panel.

The original 5-member panel had comprised of Justice Yaw Appau, with Justices Samuel K. Marful-Sau, Gertrude Torkornoo, Clemence Honyenuga, and Issifu Omoro Tanko. 

Hornyenuga was later however replaced with Avril Johnson.

It would be recalled that residents of Santrokofi, Akpafu, Likpe, and Lolobi , the so-called SALL, sued then Hohoe MP-elect John Peter Amewu and the Electorcash-strapped at the High Court in Ho.

The suit was based on the fact that even though they are constituents of Hohoe, they had not been allowed to vote in the 2020 elections through a machination of the EC.

The Ho High Court had granted a 10-day injunction against Amewu holding himself out as MP-elect accordingly.

However, Attorney General, Godfred Yeboah Dame had invoked the original jurisdiction of the Supreme Court which was then on vacation and filed an abridgment of time to force the court out of holidays to quash the Ho High Court’s ruling.

The apex court had agreed with the AG that the SALL residents do not have voting rights in Hohoe since the Supreme Court has already ruled that the area falls within the Oti region. Hohoe is in the Volta Region.

The Court also went on to rule that the disenfranchisement of over 17,000 people of the SALL had not been caused by Amewu and so he could not be blamed for it.

The people of the SALL however responded by filing for Judicial Review.
