Supreme Court Of Unanimity Gives Another 9-0 Decision Against Mahama

The Supreme Court panel hearing the 2020 presidential election petition has handed down yet another unanimous decision, dismissing a review application by the Petitioner in the case, former President John Mahama.

Following in a now well-established pattern of dismissing every application by John Mahama, the court presided over by Chief Justice Kwasi Anin Yeboah, voted 9-0 to dismiss the application asking the court to review its 16th February 2021 decision to disallow Mr. Mahama from reopening his case.

According to Justice Anin Yeboah who, as usual, read the judgment, the application by the former President lacks merit.

“We dismiss the instant application as being wholly without merit,” Anin Yeboah read. 

The panel was made up of nine judges.

Mr. Mahama had filed the review application after the apex court had dismissed his application to reopen his case, following a shrewd move by Jean Adukwei Mensa, the Electoral Commission (EC) Chairperson who announced at the eleventh hour that she would no longer testify after she had earlier sworn an affidavit that she would.

In fact, using what now looks like a pretense that she would testify, Jean Mensa had resisted moves to serve her interrogatories and also an application to inspect her documents. And on all those occasions, the Supreme Court unanimously ruled in her favour.

However, when Mr. Mahama closed his case after calling three witnesses and the stage was set for Jean Adukwei Mensa to give evidence, the EC Chairperson announced she had changed her mind.

Former President Mahama then filed an application to reopen his case so he could subpoena her to give evidence. But a Seven-member Supreme Court bench comprising Chief Justice Kwasi Anin Yeboah, Justices Appau, Marful-Sau, Nene Amegatcher, Prof. Kotey, Mariama Owusu and Gertrude Torkonoo, ruled that he could not reopen his case.

Mr. Mahama then filed for a review. That review is what has been unanimously dismissed again by a nine-member panel. Justice Imoro Tanko and Justice Henrietta Mensah Bonsu were two other judges who joined the seven-member panel for the review application.

The court has since fixed 4th March as the day it will deliver judgment in the case.
