Court Orders GES Vehicles To Be Auctioned To Settle Judgment Debts

A Koforidua High Court has ordered that some vehicles belonging to the Ghana Education Service (GES) in the Eastern Region be auctioned to settle a judgment debt of GH¢3,471,240.72 owed by the GES.

A writ of Fieri Facias covering this directive was issued by Presiding Judge, Justice Gifty Dekyem on 8th December 2021. It directed the Ghana Police Service to detail some personnel to protect and assist the bailiffs to execute the order.

A Fieri Facias Writ is a judgment or order from the court for the payment of money.

This directive from the court results from a case brought before it by 102 teachers in the Eastern Region who are owed salary arrears of more than five years.

To enforce the writ, Justice Dekyem wrote to the Eastern Regional Police Commander, saying: “I would be most grateful if you could detail some policemen to protect and assist Bailiffs to execute a writ of Fieri Facias to Plaintiff/Judgment/Creditor in the above-mentioned vehicle belonging to the 1st Defendant/Judgment debtor, Ghana Education Service, Koforidua Eastern Region.”

So far, a Toyota Land Cruiser with registration number GC 5985-20 belonging to the Eastern Regional Education Director and a Toyota pickup GV 778-20 belonging to the Regional Accountant have been impounded, according to reports.

Reports say the Birim South Municipal Director of Education, whose vehicle was located, however, managed to escape with the keys of the car.

Eighteen other vehicles are also to be impounded and later auctioned to settle a whooping judgment debt.

In the case, Eric Effah Darko leads the aggrieved teachers as Plaintiffs with the GES and the Attorney General as Defendants.
