A member of the legal team of former President Mahama in the 2020 election petition, Dr. Dominic Ayine, has given voice to his suspicion that the Supreme Court panel hearing the petition is only going through the motions of a sham trial.
Speaking to the media after another unanimous ruling against former President Mahama by the Anin Yeboah-led panel of seven today, the former Deputy Attorney General said the actions of the court smacks of a pre-cast motive to give judgment against Mr. Mahama.
“I am surprised that the Supreme Court itself, having set down 5 key issues to be determined is now reducing the issues to 1, which is, the extent to which the evidence we have laid shows that no one got more than 50%+1 of the votes,” Ayini charged.
“But we made it abundantly clear in the petition that there were a number of infractions, we are contesting even the constitutionality of the declaration that was made. We are saying that Jean Mensa violated Article 23 of the constitution because she is an administrative body. We have also said her exercise of discretion was contrary to Article 296 of the constitution.”
His reaction follows another unanimous ruling by the panel disallowing Mr. Mahama from reopening his case after he had earlier closed it.
Mr. Mahama’s application for leave to reopen his case arose from a last-minute announcement by the Electoral Commission (EC) that its Chairperson, Jean Adukwei Mensa, whose apparent dubious declaration of Akufo-Addo as winner of the 2020 presidential election, would not mount the witness box to be cross-examined.
Adukwei Mensa had earlier indicated she would do just that, using that position to successfully fend off an application by Mr. Mahama to serve her interrogatories and also an application to inspect her document.
This way, she had everybody believing she would allow herself to be questioned on how she declared election results on 9th December and later changed the figures seven times to fit what appears to be a pre-cast agenda to declare Akufo-Addo as the winner. However, Mr. Mahama and his legal team were left surprised when her lawyers said she had changed her mind.
Mr. Mahama had then filed to reopen his case so he could subpoena her, but the Anin Yeboah-led Supreme Court panel ruled today that they will not allow the former President to reopen his case.
“In our view the court was wrong. In our view, the reasons of the Court were based upon wrong legal premises. But the Supreme Court is the final justice when it comes to the law and we are bound by what it has said. We cannot depart from it,” Dr. Ayine said.
